A court marriage does not take place in a courtroom

There is no application to a court, no public notice, no objection period and no hearing before a magistrate. That procedure belongs to India’s Special Marriage Act 1954. In Pakistan the Nikah is performed by a Nikah Khawan and registered through the Nikah Registrar and the Union Council. If a website tells you otherwise, it is describing another country’s law.

How it works

  1. Documents checked and identity verified from the original CNICs.
  2. Haq Mehr settled, with any conditions the bride wishes entered in the Nikah Nama.
  3. Affidavits drafted, sworn and notarised.
  4. Nikah performed by the Nikah Khawan before two adult Muslim witnesses.
  5. Nikah Nama completed in full and filed with the Union Council.
  6. NADRA Marriage Registration Certificate obtained.

The Nikah and documentation are ordinarily completed the same day. The NADRA certificate usually follows within three to five working days of registration.

Who can marry

  • Age. Eighteen years for both parties in Punjab, Sindh and Islamabad. Parental consent cannot make an underage marriage lawful, and exposes the guardian to prosecution. Marriage age in Pakistan
  • Consent. Both parties must agree freely. Family approval is not a legal requirement between adults.
  • Marital status. Both parties must be free to marry, with proof where either was married before.
  • Religion. A Muslim man may marry a Muslim woman or a Kitabia. A Muslim woman cannot contract a valid marriage with a non-Muslim man.

Common questions

Does a judge perform the marriage?

No. The Nikah is performed by a Nikah Khawan and registered through the Nikah Registrar and the Union Council.

Can our families object?

A marriage between two consenting adults is valid regardless of family disagreement.

What does it cost?

The cost is made up of the professional fee, the Nikah Khawan’s fee, affidavit and notarial charges, Union Council registration and the NADRA certificate fee. Please contact us for a figure against your own documents.

Can this be done if one of us is abroad?

Yes, through a Wakeel appointed under a power of attorney attested at the Pakistani mission in the country of residence.
