The Nikah Nama form records the details of the Nikah (marriage). The Nikah Registrar records the names and addresses of the witnesses, the amount of dower, and the conditions of the Nikah on the Nikah Nama Form.

Nikah Nama (English/Urdu) conditions

The Nikah Nama should include the conditions of the Nikah at the time of the Nikah or before it. Under the Registration Act, 1908, the parties can, however, revise any conditions with mutual consent, which is better recorded in writing as an acknowledgement or agreement and registered separately with the Registrar.

The Nikah Nama can be broken down into three categories

  1. For the first category of columns of a Nikah Nama, both parties must provide factual information. The Nikah Khawan/Registrar must verify that the parties’ names and dates of birth match those on their ID cards or B forms. In cases where the current and permanent addresses differ, both can be mentioned. Under the Child Marriage Restraint Act, the parties are liable if the documentation is not checked and the marriage is found to be underage. 
  2.  The second category of the Nikah nama determines the bride’s marital status, and she can appoint a vakeel or representative. In the next two columns, the bride’s witnesses’ names and relationships must be filled in carefully. The witnesses need not be relatives of the bride, but they must state their relationship to the bride’s attorney (if appointed). Both sets cannot have the same witnesses.
  3. The third category of columns of the Nikah nama discusses the conditions and settlements of the marriage. Column 17 asks if there are any special conditions. You can use this column to include conditions about mutual responsibilities and other aspects of marriage. Conditions in column 17 should be time-bound, that is, applicable only within a certain timeframe or for the duration of the couple’s marriage. It is ideal that conditions be written clearly and unambiguously without anything that can be interpreted, as that may cause difficulties in enforcing them.

In many parts of Pakistan, ‘Watta Satta or exchange marriages are common, in which both parties agree to give a woman in exchange for marriage with another woman. (Similar to bartering) 

It is possible to include this condition in Nikah Namas or to draw up a separate contract on stamp paper and reference it in the Nikah Nama.

Online Nikah (Online marriage) is Valid in Islam?

Yes, Online Nikah (Online marriage) is valid in Islam. Online Nikah (Online marriage) is valid and legal under Islamic law. The only requirement for an Online Nikah (Online marriage) to be considered valid is that both bride and groom must be able to understand the meaning of the marriage contract (nikah). While this practice is not sanctioned by any government or religious authority, it does meet all of the requirements for Islamic marriage. The person who officiates the Online Nikah (Online marriage) ceremony must be an Islamic scholar or a person who has knowledge of Islamic law. The ceremony should be conducted in a way that is similar to traditional ceremonies, and both parties must agree that they are marrying each other for all of their lives.

Is it permissible for the husband to delegate talaq to his wife? If so, under what conditions? Under Muslim family law, a couple can unilaterally terminate their Nikah by pronouncing talaq, which can also be delegated to their wives. As a result, both husbands and wives retain their rights. When a woman uses her right to pronounce talaq on herself on behalf of her husband, she must follow the same procedure as a man would.

Nikah Nama column 19:

A question is asked in column 19 about restrictions on the husband’s right to talaq. Although this right can be conditional, it does not mean that the husband loses the right to pronounce talaq completely. Furthermore, a husband is not required to explain why he is divorcing his wife under the law. By following the stated procedure, talaq is affected.

Nikah Nama Legal Aspects

Dower Relinquishment Recorded in the Nikah Nama

The woman is ultimately responsible for relinquishing dower. Dower can be relinquished or gifted based on law, but it must be proved by the person who claims it. When a dispute arises, the Court must ensure that the wife was not coerced into relinquishing her dower. Relinquishing dower by affidavit requires substantiation.

Nikah Nama may also include other precious gifts for the bride

As a bride gets married, she receives bridal gifts from her mother-in-law and her parents. Jewelry given to the bride by the groom will belong to the bride, while jewelry given by the groom will belong to him. When a husband fails to honor a promise or undertaking to give her a gift (cash or property) recorded in the Nikah Nama (usually column 17), the wife may file suit for compensation.

The Nikah Nama can mention conditions that restrict polygamy

In Pakistan, a man must obtain the consent of his first wife before entering into a second marriage. The arbitration council’s permission certificate must, however, be obtained. Polygamy permits must be sought from the Union Council of the residence of the applicant’s existing wife at the time of application, even if it is in another city.

Child Marriages/Underage Marriages:

It is the Child Marriage Restraint Act (CMRA) 1929 that applies in this case. In 2015, the Act was amended, but it did not fundamentally change; merely strengthened punishments for certain violations. CMRA defines child marriage as marriage in which one or both partners are under the legal marriage age (18 for girls and 18 for boys). Although child marriage is punishable, it does not invalidate a marriage. These marriages continue until either party repudiates or ratifies them.

It is invalid to obtain a Muslim marriage by force, misrepresentation, or without free consent. It is permissible to apply the Pakistan Penal Code (PPC) or any other law that pertains to forced marriage in any form.
